These terms and conditions of brushEX® (registered trademark of Angelika Müller-Reichert, hereinafter referred to as “seller”) apply to all contracts for the delivery of goods that a consumer or entrepreneur with the seller with regard to the Internet created by the seller on this with “WIX” Trading platform (hereinafter referred to as "brushEX® online shop)" closes the goods shown. The inclusion of the customer's own conditions is hereby contradicted, unless otherwise agreed.

These terms and conditions apply accordingly to contracts for the delivery of digital content, unless otherwise expressly regulated. A consumer within the meaning of these terms and conditions is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur within the meaning of these terms and conditions is a natural or legal person or a legal partnership who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

Digital content within the meaning of these terms and conditions is all data that is not on a physical data carrier that is produced in digital form and made available by the seller under the granting of certain rights of use regulated more precisely in these terms and conditions.

Contractual partner

Conclusion of contract

With the listing of an article, the seller makes a binding offer to sell this article. The consumer can accept the seller's offer using the online order form held by WIX. To do this, the consumer must first place the desired item in the virtual shopping cart and then go through the ordering steps specified by WIX. By clicking the order button, the consumer declares acceptance of the offer, whereby a purchase contract for the goods previously selected by the consumer is concluded.
The contract text (hereinafter "invoice") is saved by the seller and automatically sent to the consumer via WIX after conclusion of the contract, along with the link to the present terms and conditions, by email. Beyond that, there is no further provision of the contract text by the seller.
Before the consumer or entrepreneur activates his order bindingly by clicking the order button as part of the electronic ordering process, he can still correct his order using the usual keyboard functions. The German language is available for the conclusion of the contract and the English language for those parts that have not been translated by WIX.

Granting rights of use for digital content

The author (hereinafter referred to as “seller”) grants the consumer the non-exclusive, geographically and temporally unlimited right to use the provided content of the digital download exclusively for private purposes.
A transfer of content a n e third or making copies for third parties or the forwarding of the file beyond the scope of these terms and conditions is prohibited. The seller must agree to a transfer of the contractual license to the third party.
